The headings and sub-headings are for convenience purposes only and shall not be used in the interpretation of, nor modify or amplify, the terms of this Agreement or any clause hereof:

• an expression which denotes any gender includes the other genders;
• a natural person includes an artificial person and vice versa and
• the singular includes the plural and vice versa;

The words “including”, “include” and “in particular” shall be construed only as illustration or emphasis and shall not be construed or take effect as limiting the generality of any earlier words.

The expiration or termination shall not affect those provisions which expressly provide that they will operate after any such expiration or termination or which of necessity must continue to have effect after such expiration or termination, notwithstanding the fact that the clauses themselves do not expressly provide this. Any reference in this document shall be construed as a reference to this Terms & Conditions and the Indemnity as at the date of acceptance by the Parent / Guardian and as may from time to time be amended, varied, novated, restated, supplemented, replaced, or substituted.

Terms & Conditions

I hereby agree that my child (also referred to as members) may join Tiny Toks and that I shall not hold Tiny Toks, its directors, shareholders, managers, staff/employees, agents, or coaches liable for any unforeseen incidents, accidents, injury or illness that may befall a child during any of the sessions/demonstrations/fun days/events. I accept that Tiny Toks always handle children with care and endeavor to the best of their ability to not expose children to dangerous activities.

I acknowledge that children’s membership fees will be payable in advance as follows:

• 12 x equal payments of R347.00 pm for 4 lessons per month + R200.00 yearly registration fee
• 12 x equal payments of R625.00 pm for 8 lessons per month + R200.00 yearly registration fee
• 12 x equal payments of R625.00 pm for 2 siblings 4 lessons each per child + R200 yearly registration fee per child.
• Rewards will be handed out during the last month of each term, to members whose accounts are paid up to date. Members will only qualify for the quarterly rewards from when they sign up and rewards won’t be backdated I acknowledge that Tiny Toks does not accept any cash and cheque payments for any lessons or merchandise. I understand and agree that all fees should be paid in advance, on or before the 1st (first) day of each month and that Tiny Toks will not be held liable for late payments. In the event of late payment, I agree that Tiny Toks can charge penalties at the prime interest rate of Tiny Toks bank (FNB), unless mutually agreed to in writing. Lastly, I also agree that a fee of R50 will be charged for all payments that are returned. I agree that lessons will only commence for my child, once payment has been made. I understand that Tiny Toks will not be held liable for ANY cash payments handed over to any party. I the undersigned (parent/guardian) acknowledge that I am liable for the cost of the admin fee and membership fees as indicated above and I hold myself bound to Tiny Toks for due and proper payment of such amounts. I acknowledge and agree that my child’s lessons will be suspended without notice if my account is in arrears at any stage and that the fees will accumulate until formally cancelled. I acknowledge that non-payment and/or subsequent suspension of lessons do not automatically terminate my contractual obligation which has to be formally terminated via the cancellation procedure, as below. I acknowledge that Tiny Toks is a private extramural activity and should be treated as such with regards to enrollments, payments, cancellations, and correspondence regarding lessons/fees.

I understand that Tiny Toks reserves the right to consider refunds on merit.

I understand that no credit or extra lessons will be given in the event of:

• my child being absent
• school/other activities clash with lesson times
• unfavorable weather conditions
• public holidays
• school holidays.

I acknowledge that I may terminate this membership by giving 1 (one) paid calendar months’ paid written notice to Tiny Toks, sent via email to admin@tinytoks.co.za and that cancellations are only valid once receipt thereof is acknowledged by return email, provided my account is paid to date. Alternatively, I can “freeze” my membership for a monthly fee of R99.00. Whereby the normal monthly membership fee or termination process will be applicable. I hereby give permission that my child may be photographed and or video recorded at any Tiny Toks lesson, training, demonstration event, including practice, and that my personal information, images/footage may be used in whole or in part in marketing material by Tiny Toks or its subsidiaries and or sponsor/s.

I acknowledge that all information supplied by me is correct and fully agree to the terms above. I acknowledge that Tiny Toks lessons will be presented from 01 February 2022 – 4 December 2022.

I acknowledge that membership works on an ongoing basis and will automatically resume each year.

I acknowledge that once I have made any payment towards registration or lessons, or if my child has attended any lessons at all, that I have accepted these Terms and Conditions tacitly and out of my own free will and agree to be bound by it.

I undertake to update my email address, contact numbers, and street address if any of my details have changed, on my online profile.

PARENT / GUARDIAN INDEMNITY FORM:

As a parent/guardian of a child/children (also referred to as members), I agree that: I understand and note the risks associated with COVID 19 and understand the manner in which the virus spreads. I am aware of and understand the operational plans and policies that Tiny Toks and the selected facilities/venues have implemented in order to minimize the risk of transmission of COVID 19. (Our operational plan is available on request) Given the nature of the COVID 19 virus, I know and understand the risks associated with sending my child to lessons/practice. I accept these risks and agree that I cannot hold Tiny Toks, its directors, shareholders, managers, staff/employees, agents or coaches liable or responsible for any cause of that may relate to the transmission of, or an outbreak of, the virus to my child or at a selected facilities/venue.

I hereby indemnify and waive any right I may have to institute any claim of whatsoever nature against Tiny Toks, its directors, shareholders, managers, staff/employees, agents’ coaches in this regard and in relation to COVID-19. This document does not exclude or limit any liability that is not capable of exclusion or limitation by law.

I, as a Parent / Guardian agree and undertake that:

• My child will, at all times, adhere to all policies that Tiny Toks or the facility/venue has put in place with regard to COVID 19 which will be communicated to all the Parties at the first return to lessons/training.
• My child will be kept at home if he/she shows any symptoms of COVID-19, or are otherwise unwell or where any immediate family/friends/ contact present with symptoms are recognized as indicative of COVID 19. These symptoms include, but are not limited to: cough, fever, tiredness, sore throat, runny nose, shortness of breath, diarrhea, headache, loss of taste or smell, rash, or chest pain.
• I will inform Tiny Toks office immediately if my child is sick or if anyone else in the household/school/place of employment or any related party has been infected with COVID 19. In this event, our family will undertake to quarantine the entire family for 14 days.
• In order to ensure the safety of all children and staff at Tiny Toks, I will provide my child with a mask and explain to him/her that the mask needs to be worn at all times when he/she is at practice at the facility.
• I confirm that I will instruct my child on how to put the masks on and take them off and how to wear them properly.
